These Terms and Conditions ("Terms", "Terms and Conditions") govern your access to and use of the website Getoutin.co.za (the "Portal") provided by GETOUTIN Pty(Ltd.), including any content, functionality, and services offered on or through the Portal. By accessing or using the Portal, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must not access or use the Portal.
The Portal is an online platform that aggregates and lists events sourced from third-party websites and allows users to contribute and post their own event listings. You are granted a non-exclusive, non-transferable, revocable license to use the Portal solely for personal, non-commercial purposes, subject to these Terms.
By using the Portal, you confirm that you are at least 18 years of age or have obtained the consent of a parent or guardian if under 18. The Portal is intended for individuals who can form legally binding contracts under applicable law.
To post events or access certain features of the Portal, you may be required to create a user account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately if you suspect any unauthorized use of your account.
Users are allowed to contribute and post event listings on the Portal. By submitting an event or other content, you represent and warrant that:
You acknowledge and agree that we reserve the right to remove, edit, or refuse to publish any event listing at our sole discretion, particularly if it is deemed inappropriate, illegal, or violates these Terms.
You retain ownership of any content you submit to the Portal, including event listings, photos, and descriptions. However, by posting content to the Portal, you grant GETOUTIN Pty(Ltd.) a non-exclusive, worldwide, royalty-free license to use, display, distribute, and promote that content on the Portal and through related marketing channels (including social media, emails, and other promotional materials).
The Portal may include content, links, or advertisements provided by third parties. We do not endorse or control the content provided by third parties, and you acknowledge that we are not responsible for any loss or damage incurred from interacting with third-party content or external links.
You agree not to engage in any of the following activities while using the Portal:
We reserve the right to modify, suspend, or discontinue the Portal and its services, in whole or in part, at any time, with or without notice. We will not be liable to you or any third party for any such changes.
To the fullest extent permitted by law, GETOUTIN Pty(Ltd.) and its affiliates, partners, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits, arising out of your use or inability to use the Portal, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold harmless GETOUTIN Pty(Ltd.), its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your violation of these Terms, your use of the Portal, or any content you post.
We may suspend or terminate your access to the Portal if you breach these Terms or if we decide, in our sole discretion, to discontinue offering the Portal or its services. Upon termination, your right to use the Portal will immediately cease, and any content you have posted may be removed or deleted.
Any disputes or claims arising out of or relating to these Terms or your use of the Portal shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if they qualify. The arbitration will be conducted in accordance with the rules of the South African Arbitration Association, and the decision of the arbitrator will be final.
These Terms will be governed by and construed in accordance with the laws of Cape Town, South Africa, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in Cape Town, South Africa for any dispute arising under these Terms.
We may update or modify these Terms at any time. Any changes will be posted on this page, and the "Effective Date" will be updated accordingly. By continuing to use the Portal after any changes to these Terms, you accept and agree to the updated terms.
